SICA Terms and Conditions of Use

1. Service owner

Hereinafter, “VisualNACert”.

These terms govern access to and use of the SICA service through its web and mobile applications and any other interfaces that may be enabled.

2. Purpose of SICA

SICA is a platform designed to facilitate the collection, structuring, georeferencing, management and analysis of information related to events that may affect farms, livestock holdings or rural land.

Among other features, SICA allows users to:

SICA may evolve and incorporate new features related to these purposes.

3. Structure and access levels

SICA may offer different environments and features depending on each user's profile and permissions.

SICA Campo

The environment intended mainly for users to record information.

Access to SICA Campo does not, by itself, grant access to the aggregated information provided by other users or to SICA's territorial analysis systems.

Each user may consult the information they have recorded and the features expressly enabled for their profile.

SICA Geo and SICA Analytics

These are restricted-access environments.

Only users expressly authorised by the relevant organisation, such as Public Administrations, associations, cooperatives, partner entities or other organisations using SICA, may access them.

The accessible content, territorial scope and level of detail depend on the permissions assigned to each user and organisation.

4. Registration and user account

An account is required to use certain SICA features.

Registration may take place:

When an account is created by an organisation, the user must accept these Terms on first access, where applicable.

The user undertakes to provide truthful, up-to-date and sufficient information and to keep their access credentials under their control.

Credentials are personal and must not be shared with third parties.

The user must notify VisualNACert of any unauthorised access or suspected misuse of their account.

5. Underage users

SICA is not restricted exclusively to persons over 18.

Minors must use the service in accordance with applicable law.

Where the processing of a minor's personal data is based on consent, users aged 14 or over may give it themselves under the legally established terms.

For children under 14, the consent of the holder of parental authority or guardianship is required where processing is based on consent.

VisualNACert may establish reasonable mechanisms to verify such authorisation where necessary.

Where the nature of the act or legal relationship legally requires the assistance or authorisation of legal representatives, that obligation applies equally.

6. Nature of communications made through SICA

Information recorded in SICA serves the purposes of knowledge, information, analysis, monitoring and generation of territorial and agronomic intelligence.

Unless expressly stated otherwise:

Where a user needs to complete any of these procedures, they must use the channels established by the Administration, insurer or competent body.

7. Information provided by the user

The user may enter, among other things:

The user must ensure that the information provided is reasonably correct and corresponds to their knowledge of the facts at the time of reporting.

SICA is designed as an information-gathering tool. VisualNACert does not guarantee that information provided by third parties is accurate, complete or has been verified on the ground.

8. Photographs and multimedia content

Photographs are intended to document an incident, phenomenon, damage or situation related to the purpose of SICA.

The user must avoid, wherever possible, photographing identifiable people when their presence is not necessary to document the incident.

If third parties, licence plates, documents, homes or other elements that may contain personal information appear, the user must respect the rights of third parties and avoid including unnecessary information.

SICA may extract certain technical metadata from photographs, such as:

Images will be used to document incidents and for purposes directly related to the management, analysis, validation and study of those incidents.

9. Geolocation

SICA may request access to the device's location for certain features.

Location may be used to:

SICA is not designed to permanently track the user's movements.

The user can manage location permissions in their device settings.

Denying the permission may limit features that need geolocation, without necessarily preventing access to the rest of the service.

10. Review and management of incidents

Persons with administration or management permissions may, within their assigned scope:

These actions may be logged to ensure the traceability of the information.

Validation of an incident within SICA is an internal information-management action and does not, by itself, amount to an administrative, insurance, expert or legal validation of the reported damage.

11. Authorised organisations and users

Certain organisations may have access to SICA Geo, SICA Analytics or other restricted modules.

Each organisation is responsible for correctly assigning permissions to its authorised users.

Users with restricted access must use the information solely for the professional, institutional or technical purposes for which they have been authorised.

Use of information obtained through SICA for purposes unrelated to the service, as well as its unauthorised extraction or dissemination, is prohibited.

12. Use of the recorded information

The user retains any rights they may hold over the content they enter in SICA.

Providing information does not transfer ownership of that content to VisualNACert.

However, the user authorises VisualNACert, for as long as necessary for the purposes of SICA, to store, organise, classify, process, technically reproduce, map, analyse, aggregate and use that content to the extent necessary to:

Wherever possible and appropriate, statistical, scientific, analytical or long-term uses will rely on aggregated, anonymised or pseudonymised information.

Personal data may not be used for purposes incompatible with those for which they were collected without an appropriate legal basis and without providing any additional information legally required.

13. Aggregated information

VisualNACert may generate maps, indicators, statistics, models, trends, reports and other results derived from the information held in SICA.

Where such results are disseminated beyond specifically authorised users, measures will be taken to avoid the unnecessary identification of natural persons.

Properly anonymised information may be retained and used for statistical, historical, scientific, technical, research, planning and agricultural and territorial knowledge-improvement purposes.

14. Prohibited uses

SICA may not be used to:

VisualNACert may restrict or suspend accounts where there are reasonable indications of a breach of these Terms, adopting proportionate measures.

15. Intellectual and industrial property

The software, interfaces, databases, designs, structures, trademarks, logos, documentation, algorithms and other elements belonging to SICA are owned by VisualNACert or lawfully used by it.

Access to the service does not grant the user any ownership rights over those elements.

The user receives only a limited, personal and non-exclusive right to use SICA in accordance with these Terms.

16. Availability and evolution of the service

VisualNACert will endeavour to keep SICA available and operational in accordance with any service levels agreed with client organisations.

Interruptions may occur due to maintenance, updates, technical incidents, security actions or causes beyond VisualNACert's reasonable control.

VisualNACert may modify or evolve SICA's features to improve the service or adapt it to new needs, technologies or legal requirements.

17. Liability

VisualNACert is liable for the service under the terms established by applicable law.

SICA is an information and support tool and does not replace the judgement of technicians, Administrations, insurers, loss adjusters or other competent professionals.

VisualNACert is not liable for decisions taken solely on the basis of information entered by users that turns out to be incorrect, incomplete or outdated, without prejudice to any liability arising by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

18. Suspension or cancellation of accounts

VisualNACert may temporarily suspend or cancel an account where:

Cancelling an account does not necessarily entail the immediate deletion of all information previously provided where it must be retained under the Privacy Policy, legal obligations, third-party rights or duly protected statistical or research purposes.

19. Data protection

The processing of personal data through SICA is governed by the SICA Privacy Policy.

The use of third-party data by authorised organisations may entail additional responsibilities for those organisations where they independently determine the purposes and means of their own processing.

20. Amendment of the Terms

VisualNACert may amend these Terms where necessary due to functional, technical, organisational or regulatory changes.

Where the changes are material, users will be informed by reasonable means and, where necessary, a new acceptance will be requested.

21. Applicable law

These Terms are governed by Spanish law and by any applicable European Union legislation.

Where the user qualifies legally as a consumer, the corresponding mandatory protection and jurisdiction rules apply.

In all other cases, and unless another applicable contractual provision exists, the parties submit to the Courts and Tribunals of Valencia.
